These Terms govern your use of PageWarden, operated by {{COMPANY_LEGAL_NAME}} ("we", "us"). By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.
The service
PageWarden is an uptime- and infrastructure-monitoring service: it performs checks you configure (website, SSL, domain, content, port, DNS), records results, detects incidents, and sends alerts. Features and limits vary by plan.
Accounts
You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be at least {{MIN_AGE}} and able to form a binding contract. Notify us of any unauthorized use at {{SUPPORT_EMAIL}}.
Acceptable use
You may monitor only targets you own or are authorized to monitor. You will not use the service to: probe, scan, or attack systems without authorization; circumvent access controls; send unlawful, infringing, or abusive content through alert channels; overload or interfere with the service; or violate any law. We may suspend accounts that abuse the service, including using it to facilitate denial-of-service or unauthorized scanning.
Plans, billing, and trials
- Paid plans are billed in advance on a monthly or annual cycle through our payment provider. Prices are shown on the pricing page and may change with notice.
- Free accounts may receive a {{TRIAL_LENGTH}} trial of paid features; unless you subscribe, the account reverts to the Free plan at the end of the trial.
- Subscriptions renew automatically until cancelled. You can cancel anytime via the billing portal; access continues until the end of the paid period. Except where required by law, payments are non-refundable.
- You are responsible for applicable taxes.
Your content and data
You retain ownership of the configuration and data you submit. You grant us the rights needed to operate the service (e.g. to run your checks and send your alerts). Our handling of personal data is described in the Privacy Policy.
Availability and "as is"
We work to keep the service reliable but do not guarantee uninterrupted or error-free operation, and the service is not a substitute for your own redundancy and incident response. The service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that monitoring will detect every issue or that alerts will always be delivered.
Limitation of liability
To the fullest extent permitted by law, {{COMPANY_LEGAL_NAME}} will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the service. Our total liability for any claim will not exceed the amount you paid us in the {{LIABILITY_WINDOW}} preceding the claim.
Indemnity
You will indemnify and hold us harmless from claims arising out of your use of the service or your breach of these Terms, including monitoring targets you were not authorized to monitor.
Suspension and termination
We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law. You may stop using and delete your account at any time. Sections that by their nature should survive termination will survive.
Changes
We may update these Terms; we will post the new date above and, for material changes, provide notice. Continued use after changes means you accept them.
Governing law
These Terms are governed by the laws of {{GOVERNING_LAW_JURISDICTION}}, and disputes are subject to the courts/forum of {{DISPUTE_FORUM}}, without regard to conflict-of-laws rules.
